Asheville is located at the confluence of the French Broad and Swannanoa Rivers. Buncombe County rests in a central area of a high plateau bordered by the Blue Ridge, Great Craggies and Black Mountains on the east and the Great Smokies chain of the Appalachians on the west. Recorded history began with the visit of Spanish explorer Hernando DeSoto to Western North Carolina In 1540. Trade was first established with the Cherokee Indians In 1643. Early trading paths followed established Indian routes which crossed at Asheville's present location. At the time of the revolution, the English had established the limits of colonial expansion westward to the foot of the Blue Ridge Mountains. This assurance of territorial Integrity aligned the Cherokee with the British. Cherokee raids on colonial settlements brought a force of colonists headed by General Griffith Rutherford Into Western North
Carolina In 1776, He destroyed Cherokee villages and broke the power of the nation.
Early settlers were largely Scotch-Irish Immigrants from Ulster in Northern Ireland, where restrictive British tariffs had ruined the wool and weaving industries. Samuel W. Davidson and his family were the first to settle in Buncombe County on Christian Creek In the Swannanoa Valley in 1784. He was later killed by Indians. He is buried on Jones Mountain. A permanent settlement was established there in 1785 in what was then known as 'Eden Land.' In later years Davy Crockett courted and wed Elizabeth Patton, a member of a leading Swannanoa family.
The County of Buncombe was established on December 5. 1791 by an act of the legislature, initiated by William Davidson and Colonel David Vance. A log courthouse was constructed in 1793 at a point which is now Pack Square. A year later John Burton obtained state grants of land for the establishment of a settlement he called Morristown. He laid out 42 half-acre lots which sold for roughly $2.50. Three years later, In 1797, it was incorporated and renamed Asheville In honor of Governor Samuel Ashe.
Baptist, Methodist and Presbyterian circuit riders brought religion to the settlers of the Southern Appalachians In the early 1800s. Methodist Bishop Francis Asbury was the most noted of these. In 1840 Asheville's population was 500; to 1860 - 1,100; 1880 - 2,610; 1890 - 10,237; 1900 - 14,694; 1930 - 50,193; 1970 - 57,681. The 1980 U.S. Census showed Asheville's population to be 60,500. and the population of Buncombe County to be 162,000. In 1828 a road following the French Broad River was completed to East Tennessee. With It wagons of settlers moving west began coming through Asheville, while droves from Tennessee and Kentucky moved herds of cattle, sheep, hogs and turkeys through to the population centers of South Carolina.
The town's growth was further stimulated by the completion of the "Asheville and Greenville Plank Road' in 1851. The wealthy and favored began to come ~o Asheville aboard four and six horse stages. The city's reputation as a health resort began to grow. When the War Between the States broke out. Asheville became a major Confederate military center. The Buncombe Rifles, first company organized west of the Blue Ridge, marched forth on April 18, 1861, with a flag made of silk dresses of the belles of the town. Captain Zebulon Vance organized shortly thereafter the Rough and Ready Guards. Of the ten companies of the 6Oth North Carolina Regiment, seven of them were Buncombe County men. An early and flourishing industry was the making of Enfield Rifles, prized by Confederate soldiers for their accuracy.
In 1878, Asheville and Western North Carolina acquired the descriptive phrase "The Land Of The Sky" which derived from a well known book by Mrs. Frances Tiernan of Salisbury, writing under the name of Christian Reid. The nickname quickly caught the attention of thousands and spread Buncombe's fame more widely than ever. When the railroad broke through the Eastern continental divide in 1880, a new era was launched for Asheville and Western North Carolina. Elaborate hotels were built, including the Battery Park In 1889. From its vantage point on "Stoney Hill," George W. Vanderbilt discovered what he described as the most beautiful spot in the world. He purchased 145,000 acres and began building one of the great country houses of the world, Biltmore House. Great religious assemblies were established In the area. A grand opera house was built, and a convention auditorium followed.
In 1900, a newly organized chamber of commerce, the "Asheville Board of Trade," launched national advertising, and proclaimed the city to be one of the "leading convention cities In the country." A new wave of luxury hotel construction began: the Langren in 1912, the unbelievable Grove Park Inn In 1913, the new Kenilworth Inn in 1918 ... and with Battery Park. The break of the land boom, followed by the great depression of the early 1930s brought financial ruin to Asheville, from which It was slow to recover. However, during this period two great natural attractions were in the making: the Great Smoky Mountains National Park and the Blue Ridge Parkway, which were to make the Asheville area the most visited recreational area in the country.
At the present time Asheville enjoys a broadly based economy supported by a thriving travel industry, conventions, widely diversified Industry, forestry and agriculture. In 1980, Buncombe County's industries Include BASF, Square D., Gerber, Ball Corporation, Beacon end Sybron/Taylor. Asheville is the junction point of two Interstate highways, 26 and 40. It is the hub of five federal highways, two Appalachian development highways, five state highways and the Blue Ridge Parkway. Southern Railway serves Asheville. The modern Asheville Airport is served by Piedmont Airlines, plus commuter airlines. The Asheville-Buncombe Consolidated Water District reservoir holds 6 billion gallons, and is centered In a remote timbered watershed covering 24 square miles. Buncombe County was served by a new $10,400.00 sewage disposal system. In 1970, Asheville earned the designation "All American City." A
new Civic Center was completed In early 1974. Asheville's most famous native son is author Thomas Wolfe, whose boyhood home is open to the public as a memorial. Evangelist Billy Graham is Asheville's most world renown citizen. - The Historic News, Feb. 1999

President-elect Barack Obamas HHS secretary nominee former Senate Majority Leader Tom Daschle (D-S.D.), who Obama also named as director of a new White House Office of Health Reform has put a premium on cooperation between the White House, Congress and major health care interest groups in the overhaul of the U.S. health care system, the Los Angeles Times reports. The Times examines Daschles book on health care called and his specific and potentially controversial plans for health care reform.



Daschle has proposed to establish a Federal Health Board modeled after the Federal Reserve to determine the medications, medical devices and other treatments that federal health care programs should cover based on cost-effectiveness. According to the Times, Daschle also has proposed a requirement that all U.S. residents obtain health insurance and the establishment of a public health plan to provide coverage for those who do not obtain private coverage. The Times also looks at Daschles virtual road map for the kind of campaign the Obama White House and its allies will probably pursue in their effort to avoid the pitfalls that doomed health care reform efforts by former President Bill Clinton in the 1990s (Levey, Los Angeles Times, 12/15). According to the Wall Street Journal, as director of the White House Office of Health Reform, Daschle will serve as a health czar of sorts one of a number of czars whom Obama has appointed to address various issues. Obama seeks to have someone in the White House with the presidents ear to coordinate policy and give the topic the weight it deserves, and the appointment of a czar gives an issue prominence, allows for coordination among agencies and streamlines decision making, the Journal reports (Meckler, Wall Street Journal, 12/15).



Daschle will have a role on health care reform that truly does represent a czar role, Phil Blando of the health care consulting group AB+M Partners said, adding, s the go-to guy across the board. People will try to end run around him, and theyre going to have nowhere to go (Frates, The Politico, 12/13).
Next NIH Director Faces Budgetary Issues

The next NIH director will face a number of budgetary issues, among other concerns, the Washington Post reports. According to the Post, over the past five years, the NIH budget has risen only slightly, and when adjusted for inflation, has declined. Obama during his campaign promised to double the research budgets of key science agencies, such as NIH, over 10 years. However, whether that is still the plan, given the nations current economic straits, is unknown, according to the Post.



In addition to budgetary issues, the NIH director will face pressure to strengthen conflict-of-interest rules governing scientists at universities and medical schools who get money from the agency and will have to address a flood of requests for grants in the event that Obama overturns current restrictions on federal funding for embryonic stem cell research, the Post reports.



An additional major question facing the new administration is what role, if any, the NIH will play in the huge number of cost-effectiveness, comparative-effectiveness, quality-improvement and patient-safety studies that many health care policy experts say must be done to get the full value of the products of medical research, according to the Post. Experts maintain that many such studies are going to have to be done by someone if the Obama administration is serious about health care reform, the Post reports.



No leading candidate for the next NIH director has emerged, according to observers (Brown, Washington Post, 12/13).
VA Funding Proposal Faces Obstacles

A campaign promise by Obama to provide more stable and transparent funding for the Department of Veterans Affairs health care system faces a number of obstacles in the 111th Congress, even among Democrats, CQ Today reports. Days before the election, Obama promised to ask lawmakers in 2009 to pass appropriations bills for VA for fiscal years 2010 and 2011. Veteran advocacy groups have said that VA cannot run a health care system without knowing how much money will be available in the future, according to CQ Today.



Obama likely will receive support for the problems from several important lawmakers and some congressional institutions. However, the implementation of a proposal that would provide one agencys spending farther into the future and subject the rest to the regular order would be unusual and perhaps logistically difficult, according to CQ Today (Johnson, CQ Today, 12/12).

A Missouri woman was convicted of three federal misdemeanor crimes for pretending to be a teenage boy, courting a 13 year old classmate of her daughter's and then sending abusive messages over Myspace to the young girl. Apparently, one of the messages sent by the defendant told the young girl that the world would be better a better place without her. The girl, who was suffering from depression, committed suicide.
As a result, federal prosecutors in Los Angeles, where the Myspace servers are located, charged the Missouri woman with three misdemeanor counts for violating the federal Computer Fraud and Abuse Act. Some were critical of these charges because the Computer Fraud and Abuse Act was originally conceived to deal with computer hackers, not people who send inappropriate and abusive messages over social networking sites like Myspace. This prosecution represented an extension of that law to include inaccurate information sent over social networking websites, which have become very popular with young people and are increasingly popular among older people and professionals. While this case was obviously an extreme example of Internet abuse with tragic results, it does raise the concern that prosecutors can use federal laws designed for another purpose to charge people with crimes for being abusive and sending out false information over the Internet. There is no specific federal criminal law that specifically addresses that type of behavior over social or professional networking sites
At the trial, prosecutors were able to use the fact that the Missouri woman violated the Myspace terms of service which require Myspace users to transmit accurate and truthful information. In addition to the fact that few people read the lengthy terms of service information before signing up for such a website, this also raises the concern that a private company is setting standards that can be used to substantiate a criminal prosecution. If the rules and regulation set forth by a website like Myspace can form the basis for a criminal prosecution, people should be notified as such before registering for the site. Additionally, if websites like Myspace have some influence over the standard to be used to define criminal behavior on their website, should such websites then have some obligation to prevent its users from committing those crimes on their websites. In other words, if a Myspace user is being verbally abusive towards another user, does Myspace have an obligation to monitor that activity and delete the abusive comments and cancel the accounts where the Myspace terms of service are being violated in such a way that criminal laws are possibly being violated.

Interest rates have been fluctuating since the last 6 years, so much so that
the consumer is not sure of the future. In March 2000, the interest rates on
home loans were about 14%; which started falling quite steeply. By the last
quarter of 2003, the interest rate (floating) on home loans fell to 7%. Again
the loan interest waves have splashed to a high of around 10.00% (floating
rate of interest) in January 2007. This hike is dramatic; considering that it

During the course of the presidential election we heard all about the economy, battling terrorism, cutting taxes, and saving the environment. But for myself, as a criminal defense attorney, there was one over riding issue: Supreme Court Justice John Paul Stevens. Originally a Ford appointee in the mid 1970s, Mr. Stevens has been serving on the US Supreme Court for over thirty years. You don't hear much about him in the news. He is less colorful than many of the other more outspoken justices. When they show the photos of all the justices in the New York Times after a big opinion has been handed down, he is the gentleman in the bow tie who appears to be markedly older than the other justices. In fact, Mr. Stevens is now well into his 80s. My biggest fear this election season was we would lose Mr. Stevens' wisdom on the court and he would be replaced by a Palin/McCain appointee. This was just too much for me, an independently minded voter who leans left on some issues, right on others.

You see, Mr. Stevens has usually been over the years that crucial 5th vote on all those Supreme Court opinions involving our First, Fourth and Sixth Amendment rights as well our right to privacy. He is one of the justices most concerned about the rights of the criminally accused and for making sure that our zealous pursuit of justice does not mean we toss out our constitutional guarantees protecting all of us from unjust and unconstitutional criminal prosecution by the government. As for the second amendment, he and I respectfully disagree. But hey, no one's perfect.

So Justice Stevens, I say relax, enjoy, and perhaps think about retiring sometime in the next two or three years to a life of pleasure and peace after work so well done for so long. It is safe to do so now and thank you for remaining on the bench these long past eight years as the court hung in the balance between established precedent and reactionary revisionism. By remaining on the bench, you have ever so quietly, and ever so completely, protected all of us from losing many of our most cherished constitutional liberties. May God bless you, as he has blessed us with your long life and service.

For in true adventure we find much more than the cheap thrill of adrenaline, we find ourselves. Adventure is the element of a full life that is perhaps most neglected in modern society, and it is one of the most crucial. To have grand adventures and be able to tell tales of them is central to manliness. The problem is that in our age of technological revolution we have written off adventure and exploration as things of the past, no longer necessary thanks to our newfound, ever evolving capabilities. Although true exploration, in the sense of discovering new things, is now mostly the realm of astronauts and deep sea divers, adventure is available to anyone. What we need to realize is that it is not the discovery of new things that is important for the average man, but the understanding of ourselves which we often acquire through high adventure. Apples iPhone 3G took another step closer to China today on news the country could issue 3G licenses to local mobile phone carriers within weeks.
Speaking at a press conference, Chinese industry minister Li Yizhong confirmed the country will award three licenses,, including global 3G standards, and China’s local technology, TD-SCDMA. China Unicom will be assigned W-CDMA and China Telecom will be given CDMA-2000.

Dear Eolake,

Well, finally, I have decided to write to you. You get today a two-in-one mail from me. One part is my story, as a Domai reader, the other is my first submission to Domai as a blossoming photographer. I hope you enjoy both.

My gratitude goes to you for having created this site which has made me more self-confident and inspired as a woman and as a photographer (not professional, but autodidact and passionate photographer). It made me more aware of my own beauty and of the beauty I can capture through the lens.



So here is my story, the story of how I discovered your site three years ago and how much good it did me. I think it is a great thing to share happiness and beauty and the job you are doing is great. You are channeling positive energies through the web.

It was winter-time, November, and the shiny young man I was interested in was not interested in me. We were having very nice discussions, but that was it. I was feeling invisible as a woman as, I had to admit, I always did when attracted to somebody. I kind of started to look at pictures on the web thinking I should learn to be more sexy. Some were funny, some were nasty, but basically not giving much inspiration. Then I bumped into a page explaining the concept of simple nudes with a bunch of links. I followed some links and discovered Domai. I immediately liked the site’s name because it reminded me of an Indonesian word (I'm actually writing a book about Indonesia) and it wasn't until half a year later I found out the actual meaning. I found there so much beauty. So much fun and sunshine in wintertime. Young ladies all naked, climbing on trees, swimming in rivers, flying with umbrellas, so happy and free I had to smile back at them.

I have been taking pictures and drawing since I was 14 so I could really appreciate the aesthetics of the pictures. I could feel there had been a nice communication between the photographer and the model. Actually a lot of pictures were the kind of pictures I liked to take myself. I mean... I had never taken any naked pictures but I especially liked to take portraits. I liked to make people feel really comfortable so that, through the image, a glimpse of their inner beauty might be revealed. I loved to make somehow “true” pictures that people would accept and treasure. So I was feeling very much at home with most of the Domai pictures. I had been making portraits of peoples' faces. These pictures were portraits of the whole body, of the totality of the women.

Looking at Domai, nudity was becoming more and more natural to my eyes. I remember one day I saw women with lingerie on a newspaper advertisement and I felt those pictures so deeply artificial... At that moment, I realized I had become seriously Domai-addicted and that it had changed the way I was looking at nudity.

Somehow a magic started. Looking at those girls on Domai being happy, free and beautiful made me myself feel more and more happy, free and beautiful. It was as if their energy, their glow was coming through the pictures. Somehow, while looking at them, I was them, and they were me and it was also me who was climbing on the tree and swimming in the river. I don’t know how this magic operates but day by day I was going on the site and feeling vitality, flying away from fears and cold. The girls were all shaped different, thin or large, some bigger here or smaller there, with their bodies as personal, unique and beautiful as their faces. By looking at their pictures, nudity was becoming more and more natural, and... maybe it sounds weird, but I was feeling my body more and more belonging to me.

It was part of my personal growth and healing. Actually I am one of those girls who got somehow abused when they were young. I was much luckier than many, I was not raped, nor was I seriously aggressed, but my mum’s second husband kind of tried to be close to me in an explicitly not father-like way. I talked to my mum about the problem once when I was 13. She did not seem to take it seriously, so I did not talk about it any more. Actually, many years later, I got to know that she had taken it seriously and had she known anything had happened again, she would have divorced on the spot. But I did not tell her. Fear brings distrust. So I made myself as small, diplomatic and invisible as I could. I spent a lot of time out of house, and two years later left home.

There is the saying that “What does not kill you makes you stronger.” I think it could be obscene to state it as a general rule. Two girls I know of, one raped by her priest when she was 12, the other by a neighbor when she was 4, never got over it. Maybe the saying does not apply to them because a part of them was actually killed. People having limbs taken by accidents or wars would probably also not like to hear that saying... Actually it is the kind of wisdom that everybody can feel free to apply on one’s situation or not. For me it worked. This story made me more mature, made me start working for money earlier, enjoy more being at school and, later, when my mother divorced, really enjoy being at home. Life gave me a real problem to deal with, and through it I gained the self-confidence to deal with real problems. I met wonderful people on my way but with attractive boys I remained invisible. It was as if I had an integrated alarm system that would switch me off and make me invisible when close to a boy I felt attracted to. The clothes I would wear were for hiding, still afraid of generating attraction.

I would say that Domai was one of my gurus and finally helped me through this, more than ten years after the happenings. The beauty of the girls in the pictures made my body feel more free and shiny. The letters posted on the site were so sweet, conveying a whole philosophy of respect and love for female beauty that I started to feel differently about myself. I started to see myself and other women around me through Domai perspective. It was quite transcendental. I could feel more and more that I was young and beautiful with nothing to hide.

During those four months, November to February, I was checking Domai every day, and it really changed me. By February the guy was still not interested. One day I got fed up with the situation and decided to let it go, not to have hopes any more, it could still be a very nice friendship. That very evening there was a party and I danced feeling young, happy, beautiful and free. That was the moment when he became attracted to me.

Domai changed my way of seeing the body in general. I see more glow and beauty in it than before. I think this site is spreading love, health and peace of mind. May it be blessed.

At first I was feeling quite weird about being a woman taking pictures of a naked woman. Maybe still the old “hiding-reflex”, feeling that a naked body has to be hidden, even when it is somebody else’s body. But as my model was relaxed and very friendly I too relaxed and could be the photographer, helping her beauty to unfold. I am very happy with the pictures we made! Really. When I looked at them, I was overwhelmed. I was feeling these were the pictures I always wanted to make. It made me more complete as a photographer and as a human being. Through my friend’s beauty caught in those pictures, it was magically also my own beauty that was shining back at me. The beauty of a woman no longer afraid of her own beauty.

I feel that these pictures are my last steps on my path of personal healing, and my first steps on a long road of photography where I would not have ventured without Domai.

University of Utah researchers have developed an automobile ignition key that prevents teenagers from talking on cell phones or sending text messages while driving.
The inventors are hoping the insurance industry will back the safety technology as worthy of premium discounts for its users.
The university has obtained provisional patents and licensed the invention - Key2SafeDriving - to a private company that hopes to see it on the market within six months at a cost of less than $50 per key plus a yet-undetermined monthly service fee.
The key to safe driving is to avoid distraction, says Xuesong Zhou, an assistant professor of civil and environmental engineering who co-invented the system with Wally Curry, a University of Utah graduate now practicing medicine in Hays, Kan. We want to provide a simple, cost-effective solution to improve driving safety.
Zhou notes that at any given time, about 6 percent of travelers on the road are talking on a cell phone while driving. Also at any given time, 10 percent of teenagers who are driving are talking or texting. Studies have shown drivers using cell phones are about four times more likely to get in a crash than other drivers.
As a parent, you want to improve driving safety for your teenagers, he says. You also want to reduce your insurance costs for your teen drivers. Using our system you can prove that teen drivers are not talking while driving, which can significantly reduce the risk of getting into a car accident.
If things go as planned, the Key2SafeDriving system wont be sold directly to consumers by a manufacturer, but instead the technology may be licensed to cell phone service providers to include in their service plans, says Ronn Hartman, managing partner of Accendo LC. The Kaysville, Utah, company provides early stage business consulting and seed funding. It has licensed the Key2SafeDriving technology from the University of Utah and is working to manufacture and commercialize it.
Hartman envisions gaining automobile and insurance industry backing so that Key2SafeDriving data on cell phone use (or non-use) while driving can be compiled into a safety score and sent monthly to insurance companies, which then would provide discounts to motorists with good scores. The score also could include data recorded via Global Positioning System (GPS) satellites on the drivers speeding, rapid braking or running of lights, which are calculated by comparing the drivers position with a database of maps, speed limits, stop lights and so on.
How Key2SafeDriving Works
The system includes a device that encloses a car key - one for each teen driver or family member. The device connects wirelessly with each key users cell phone via either Bluetooth or RFID (radio-frequency identification) technologies.
To turn on the engine, the driver must either slide the key out or push a button to release it. Then the device sends a signal to the drivers cell phone, placing it in driving mode and displaying a sign on the phones display screen.
While in driving mode, teen drivers cannot use their cell phones to talk or send text messages, except for calling 911 or other numbers pre-approved by the parents - most likely the parents own cell numbers.
Incoming calls and texts are automatically answered with a message saying, I am driving now. I will call you later when I arrive at the destination safely.
When the engine is turned off, the driver slides the key back into the device, which sends a car stopped signal to the cell phone, returning it to normal communication mode.
The device cant be by turning the phone off and on again because the phone will receive the driving mode signal whenever the car key is extended.
Adult drivers cannot text or use a handheld cell phone, but the Key2SafeDriving system does allow them to talk using a hands-free cell phone - even though studies by University of Utah psychologists indicate hands-free phones are just as distracting as handheld phones.
Curry agrees that driving while talking on any cell phone is not safe, but he says the inventors have to face the practical issue of whether adults would buy a product to completely block their cell phone use while driving.
Limiting some cell calls by adults is a step in the right direction, he says.
Zhou says the goal for adults is to improve safety by encouraging them to reduce the time they spend talking while driving. The encouragement could come in the form of insurance discounts by insurers, who would receive monthly scores from Key2SafeDriving showing how well an adult driver avoided talking while driving.
An Invention is Born
The new invention began with Curry, a Salt Lake City native who graduated from the University of Utah with an accounting degree and premedical training in 1993. He returned from the Medical College of Wisconsin for his surgical residency in urology at University Hospital during 1998-2003. He now is a urologist in Hays, Kan.
His concern with driving-while-talking began because, as a doctor, the hospital is calling me all the time on my cell phone when Im driving.
One day while driving home, he saw a teenage girl texting while driving, making him worry about his 12- and 14-year-old daughters, who are approaching driving age.
I thought, this is crazy, there has got to be something to stop this, because not only is she putting people at risk, but so was I, Curry says. It struck me pretty hard that something should be done.s initial idea was a GPS system to detect a moving cell phone and disable it when it moved at driving speeds. Meanwhile, someone else developed a similar system based on the same idea. But it cannot distinguish if the cell phone user is driving a car or is a passenger in a moving car, bus or train - a problem overcome by Key2SafeDriving.
In early 2008, Curry called Larry Reaveley, a civil engineering professor at the University of Utah, who suggested Curry contact Zhou, a specialist in transportation systems. Zhou and Curry then came up with the idea of blocking cell phone usage via a vehicle ignition key.
Zhou, a native of Liuzhou, China, joined the University of Utah faculty in early 2007. He received his Ph.D. degree from the University of Maryland in 2004. He has worked for a California company that sold a product that provides traffic information to motorists using GPS satellites.

The Virginia Attorney General is petitioning the U.S. Supreme court in an effort to get the state’s anti-spam law reinstated. It was overturned in September by the Virginia Supreme Court. The court deemed it unconstitutional and a violation of the First Amendment because it prohibited the anonymous sending of bulk mail. They feared the possibility of an individual being prosecuted for sending religious or political emails.
In his petition, Attorney General Bob McDonald argued that the justices based their decision on a hypothetical situation that isn’t likely to happen. That decision led to the conviction of one of the world’s worst spammers being thrown out. Jeremy Jaynes had been first person in the country convicted of a felony for spamming. He allegedly sent close to 10 million emails a day from his home. If the law is reinstated, so will that conviction.

sometimes these people get hurt in the process. Whenever I have a client who wants to "work off their charges," I attempt to dissuade them. I tell these clients that I once represented a client who was charged with murder, for allegedly chasing down a CI and emptying his gun into her head. The bottom line is that I, and their family, would rather see them in prison than see them dead.
Which creates a bit of a conflict for me in representing confidential informants, as well as cooperating co-defendants and jailhouse snitches. The first for the reasons above, and the latter two because I feel that their coerced testimony is destroying the integrity of our justice system. But, there is a conflict with my conflict. If I am to provide the most effective defense possible, aren't these individuals entitled to my assistance in gaining them every advantage possible within the system the way it currently is?
If it is a retained case, I can certainly enter into an agreement with them prior to representation that they understand I will not represent informants, and that if a situation arises where they may benefit from informing I will assist them to find other counsel before I withdraw from their case. But I don't think that I can ethically do this in appointed cases. Appointed clients have no choice as to who their counsel is, and there is no agreement that we enter into prior to my accepting their case. The court says take this case, I accept it without question unless there is a conflict with other clients, and then I do everything I can to help the appointed client.
This is an issue that I don't have an answer for yet. My position right now is that I will attempt to discourage my clients from cooperating or informing, but I also make sure that they fully understand any benefits that they may gain from it. It is their decision, and if they decide to inform or cooperate I will reluctantly support them. At some point in the future I may change my policy on this, but I need more soul-searching and input from other defense attorneys. I am interested in hearing how others deal with this dilemma, or if it is even a dilemma for others.
